Terms of Service

Overview

This website is operated by PARPLAY Golf, operated by ParPlay International Limited.

Throughout the website, the terms “PARPLAY,” “we,” “us” and “our” refer to PARPLAY Golf.

By accessing our website, purchasing a product or using one of our services, you agree to these Terms of Service.

Nothing in these terms excludes, restricts or modifies any rights available under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or other applicable New Zealand law. Products sold by New Zealand businesses must meet applicable guarantees relating to quality, description and fitness for purpose.

1. Online Store

You must provide accurate and current information when placing an order.

You may not use our website or products for unlawful, fraudulent or unauthorised purposes.

We reserve the right to refuse or cancel an order where:

  • Product information or pricing contains an obvious error
  • Payment cannot be verified
  • Fraud or misuse is suspected
  • The product is unavailable
  • Delivery cannot reasonably be completed
  • The order breaches these terms

Where payment has already been received for a cancelled order, an appropriate refund will be provided.

2. Product Information

We aim to ensure that product descriptions, specifications, prices, photographs and availability are accurate.

However:

  • Colours may appear differently depending on the customer’s screen
  • Product measurements may have reasonable minor variations
  • Manufacturer specifications may change
  • Pre-owned items may show signs of previous use
  • Product packaging may differ from photographs

If a material error affects your order, please contact us so we can provide an appropriate remedy.

3. Pre-Owned Products

Pre-owned clubs and equipment may show cosmetic wear consistent with their age, price and stated condition.

This may include:

  • Scratches
  • Paint wear
  • Bag chatter
  • Face wear
  • Shaft marks
  • Grip wear
  • Minor cosmetic corrosion

Known material faults will be disclosed where reasonably identifiable.

Customers should review all photographs, specifications and condition information before purchasing. Disclosed wear or damage forms part of the product’s stated condition.

Applicable rights under New Zealand consumer law continue to apply to pre-owned products sold by a business. The age, price, disclosed condition and reasonable expected durability of the product may be considered when assessing acceptable quality.

4. Pricing and Payment

All prices are displayed in New Zealand dollars and include GST where applicable.

Available payment methods will be shown at checkout.

We may change prices at any time, but confirmed orders will not normally be affected unless there has been an obvious pricing error.

Ownership of the product does not transfer until full payment has been received.

5. Orders

Receiving an order confirmation does not necessarily mean the order has been finally accepted.

An order is accepted when it has been processed and dispatched, or when we otherwise confirm acceptance.

Because most pre-owned clubs are unique, stock quantities are often limited to one. Occasionally, an item may sell through another channel before inventory updates. Where this occurs, we will contact you and provide a refund or suitable alternative.

6. Shipping and Delivery

Shipping rates, processing times and estimated delivery periods are described in our Orders and Delivery Policy.

Delivery estimates are not guaranteed and may be affected by courier delays, rural delivery requirements, weather, public holidays or circumstances outside our reasonable control.

PARPLAY remains responsible for meeting its obligations under applicable New Zealand consumer law.

7. Returns and Refunds

Returns, refunds, repairs and exchanges are handled according to our Returns and Refunds Policy.

Change-of-mind returns may be limited or excluded for:

  • Pre-owned clubs
  • Used golf balls
  • Clearance products
  • Personalised products
  • Customised clubs
  • Special-order products
  • Completed Club Lab services

These exclusions do not remove any rights relating to faulty, incorrectly supplied or materially misdescribed products.

8. Club Lab Services

Club Lab work is assessed individually.

Before work begins, we may provide an estimate based on the information and photographs supplied. The final price may change if additional faults or required work are discovered after inspection.

Customers acknowledge that:

  • Restoration cannot always remove every scratch, dent or mark
  • Original finishes, markings or plating may be altered
  • Restoration may affect collector originality or manufacturer warranties
  • Adjustments must remain within the safe limits of the club
  • Older components may fail during otherwise reasonable repair work
  • Colour and finish results may vary according to the original material

We will seek approval before completing materially different additional work.

PARPLAY Club Lab services will be performed with reasonable care and skill as required by applicable New Zealand consumer law.

9. Custom and Personalised Products

Customers are responsible for checking names, wording, colours and design details before approving personalised work.

Once production or customisation begins, the order cannot normally be cancelled because of a change of mind.

We may refuse designs that are unlawful, offensive, misleading or infringe another party’s intellectual property.

10. Trade-Ins and Consignment

Trade-in values are estimates until the item has been physically inspected.

We may revise or withdraw an offer where:

  • The condition differs from the information provided
  • The item is damaged
  • Specifications are incorrect
  • Parts are missing
  • Authenticity cannot be reasonably confirmed

Customers must have the legal right to sell or consign the product.

11. Intellectual Property

The PARPLAY name, logos, photographs, product designs, website content and other brand materials belong to PARPLAY or their respective owners.

They may not be copied, reproduced, altered, sold or commercially used without prior written permission.

Third-party brand names and trademarks remain the property of their respective owners. Their appearance on our website does not imply sponsorship or endorsement unless expressly stated.

12. Third-Party Services

We may update, suspend or discontinue parts of the website where reasonably necessary.

14. Liability

To the maximum extent permitted by law, PARPLAY is not responsible for indirect or consequential loss arising from the use of our website or products.

Nothing in this section limits any liability or customer right that cannot legally be excluded under New Zealand law.

15. Changes to These Terms

We may update these Terms of Service from time to time.

The latest version will be published on this page with an updated effective date.
